If it is revealed that the decision on the presence of an occupational disease depends on the interpretation of testimonies, on theevaluation of facts which are not purely medical or if certain materials are lacking which are important for medical evaluation ofthe problem, health workers should not implement the legal act of certifying an occupational disease. In that instance this is solelywithin the competence of a legal court.
